Online Store Terms and Conditions of Sale
1. GENERAL PROVISIONS
1.1. These Mydentity online store (hereinafter: the online store) terms and conditions of sale (hereinafter: the terms and conditions) are in effect upon making purchases from Mydentity online store at the Internet address of www.mydentity.eu.
The seller of the goods is ID Color OÜ (hereinafter: the seller), address Pirita tee 20 P, 10127 Tallinn, registry code

The terms and conditions apply to legal relationships arising between any person (hereinafter: the customer) and the seller upon purchasing goods via the Mydentity online store.
1.2. The seller has the right to unilaterally amend and modify the terms and conditions, publishing the new terms and conditions at the Internet address of www.mydentity.eu. If the customer placed an order before the amendments to the terms and conditions took effect, the terms and conditions in effect at the time the order was placed apply to the customer.
1.3. The customer can save, print and, if necessary, reproduce the terms and conditions before making a purchase and, upon making a purchase from the online store, the customer agrees to the provisions of the terms and conditions.
1.4. In addition to the terms and conditions, making a purchase from the online store is subject to the legislation in force in the Republic of Estonia.
2. PLACING AN ORDER
2.1. Orders can be placed in the Mydentity online store by logging in as a loyal customer.
2.2. The customer chooses the requested goods in the online store and adds them to the cart.
2.3. The customer confirms the cart and pays for the goods in the payment environments provided by the seller. Before payment of the invoice, the customer checks that the list of the products on the invoice is in compliance with the actual request of the customer.
2.4. After having paid for the goods, the customer must click on the ‘Return to merchant’ link.
2.5. The seller sends the customer acknowledgement of receipt of the order and payment as well as an invoice by e-mail.
2.6. A contract of sale between the seller and the customer takes effect as of the moment the purchase amount paid by the customer has been credited to the seller’s bank account in full.
2.7. If the order includes goods in respect of which the order cannot be completed, the seller refunds the amount paid for such goods to the customer no later than within 14 days.
3. PRICE OF GOODS AND PAYMENT METHODS
3.1. All the prices of the goods sold in the Mydentity online store are indicated in euros. The prices are subject to value added tax of 20%.
3.2. The customer pays for the order the entire amount of the sales price and delivery fee in advance. Payment is made outside the online store in a secure environment – upon payment via a bank link, in the secure environment of a corresponding bank and, upon payment by credit card, in the secure environment of Maksekeskus AS. The seller has no access to the customer’s bank or credit card details.
3.3. The data controller for site is ID Color OÜ. To process payments ID Color OÜ will transmit personal data to the authorised processor Maksekeskus AS.
3.4. Payment for the goods can be made:
3.4.1. by invoice (for Contrtacual Customers)
3.4.1. via bank links in Internet banks: Swedbank, SEB Pank, LHV Pank, COOP bank and Luminor Pank.
3.4.2. by Visa and MasterCard credit cards.
3.5. Service fee may be added to the order value in accordance with an agreement entered into between the customer and the issuer of the bank or credit card.
4. DELIVERY OF GOODS
4.1. The goods are delivered to the territory of Estonia, Latvia and Lithuania via the Omniva courier service.
4.2. Upon delivery of the goods to the address indicated by the customer, the delivery fee plus value added tax of 20% is added to the price of the goods. If the value of the order exceeds 100 euros plus value added tax of 20%, no delivery fee is added.

4.3. Goods purchased from the online store arrive within 1-7 working days of entry into force of the contract of sale.
5. INSPECTION OF GOODS
5.1. If the customer discovers, upon receiving the goods, that the goods sent to them are incorrect or defective or the goods do not reach the customer in good condition and in closed package, the seller’s customer service must immediately be notified thereof by sending an e-mail to firstname.lastname@example.org.
5.2. The seller is liable for the goods purchased by the customer during the transport thereof. The risk of damage to or loss of the goods transfers to the customer as of the moment of receipt of the goods.
6. PROCESSING OF CUSTOMER’S PERSONAL DATA
6.1. The seller has the right to process the personal data provided by the customer as well as the purchase data in compliance with the legislation in force to the extent that is necessary, above all, for fulfilling an order placed by the customer in the online store.
6.2. The seller processes the customer’s personal data for the following purposes:
a) fulfilment of an order placed in the online store;
b) online store customer relationship management and communication with the customer;
c) responding to customer queries;
d) preparation of sales statistics;
e) management and development the online store services.
6.3. The seller applies all measures (incl. administrative, technical and physical measures) to protect the customer’s personal data. Only authorised persons have access to amending and processing the data.
6.4. The seller has the right to carry out a profile analysis of the personal data registered in the online store in order to better understand customer expectations and, based on this, provide better goods and services, enabling more accurate direct marketing.
7. RETURN OF GOODS AND REFUNDS
7.1. Upon request, the goods purchased from the online store can be returned. The right to return is in effect within 14 calendar days of receiving the goods and this is also the case if the goods are not defective.
7.2. The goods to be returned must be unused and not spoiled. The customer has the right to examine the goods in such a manner that is permitted in a regular store and the customer is liable for any impairment of the goods arisen upon examining the goods.
7.3. If the customer has spoiled or damaged, intentionally or due to negligence, the goods to be returned, the seller has the right to refuse to take back the goods or to request that the damage caused be compensated.
7.4. To return the goods, the customer must fill in an application for return. The goods to be returned along with a corresponding application must be returned to the seller to the address: ID Color OÜ, address Pirita tee 20 P, 10127 Tallinn, Estonia.

7.6. Upon exercising the right of withdrawal, the customer is required to return the goods to the seller no later than within 14 days of submitting the withdrawal application.
7.7. If the customer has withdrawn from a transaction, the seller returns the customer the purchase amount along with the delivery fee immediately, but no later than within 14 calendar days of the day when the seller received the withdrawal application. The refund is made to the same bank account from which the purchase was paid for.
